Welcome to kya.vouched.id (the "Website") operated by Vouched Identity, Inc. ("Vouched"). These Terms of Use ("Terms") govern your use of the Website and all tools, features, and functionality available through the Website, including AI agent detection, governance, enforcement and authorization services, and AI visibility auditing services (collectively, the "Services"). Your use of the Website is subject to these Terms, which may be updated by us from time to time pursuant to Section 1 herein.
By accessing and using the Website or the Services, you accept and agree to be bound by these Terms and you acknowledge having read our Privacy Statement found here and our Cookie Policy found here. If you do not agree to these Terms, you should not access or use the Website or the Services. In addition, when accessing the Website or the Services, you shall be subject to any posted guidelines or rules applicable to the Website or the Services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into these Terms. You must be 18 or over and capable of forming a binding contract to use the Website and the Services. If you are accessing or using the Website or the Services on behalf of any entity, you represent and warrant that you are authorized to accept these Terms on such entity's behalf.
These Terms, or any part thereof, may be modified by us, including the addition or removal of terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your use of the Website after such posting shall be deemed to constitute acceptance by you of such modifications, additions or deletions.

Subject to these Terms, Vouched grants you a revocable, non-exclusive, non-transferable, non-sublicensable license to access, implement, and use the Services solely for their intended purposes as described on the Website and in accordance with these Terms.
You are solely responsible for implementing and using the Services in compliance with all applicable laws, including privacy and consumer protection laws. You will provide all notices and obtain all consents required for deployment of any technologies in connection with the Services, including pixels, beacons, middleware, cookies, scripts, and agent identity credentials, and for collection of any data you choose to capture or associate with the Services. You are solely responsible for how you configure and use any enforcement policies, the scope and duration of any delegations or permissions you grant to AI agents, and the actions of any agents you deploy using the Services.
Without limiting the restrictions and limitations found regarding the Website and Content found elsewhere in these Terms, you may not:
You acknowledge that we have no obligation to provide technical or other support for the Services, though we may choose to do so at our discretion. We make no guarantees regarding the availability or performance of the Services.
The Services provide tools and assessment data, not definitive determinations. Without limiting the disclaimers in Section 7, you acknowledge and agree: (a) false positives and false negatives may occur in agent detection, and enforcement policies may not identify or block all agent traffic; (b) AI visibility audit scores and recommendations are informational only, and Vouched does not guarantee that following any recommendations will improve your site's visibility to any AI model; (c) Vouched provides agent deployment frameworks and governance tools but is not responsible for the actions, outputs, or behavior of any agent deployed or authorized using the Services; (d) cryptographic identity, delegation, and proof mechanisms are provided "as is", and you are solely responsible for configuring appropriate permissions and consent flows; (e) assessment results are informational and do not constitute a security audit or certification; and (f) responses generated by any chat or conversational features of the Services are informational only and do not constitute professional, security, or technical advice, and Vouched does not guarantee the accuracy, completeness, or reliability of any such response. You should not rely solely on the Services for critical security or access control decisions and additional verification methods may be necessary for high-stakes determinations. Vouched does not guarantee the accuracy, completeness, or effectiveness of any detection, classification, score, recommendation, or other output provided by the Services. Final decisions regarding how to interact with detected agents, what permissions to grant, and what enforcement actions to take rest solely with you.
The following additional terms apply to your use of any application programming interface ("API") made available through the Website.
Subject to these Terms, Vouched grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the API solely for the purposes described in the applicable API documentation provided by Vouched.
You are responsible for maintaining the confidentiality and security of your API keys and access credentials. You shall not share API keys with unauthorized third parties. You are responsible for all activity that occurs under your API credentials.
You shall not: (a) exceed any rate limits or usage quotas established by Vouched; (b) use the API to build a competing product or service; (c) resell, redistribute, or sublicense API data to any third party; (d) use the API in any manner that interferes with the performance or functionality of the Website or the Services; or (e) access the API by any means other than the interfaces provided by Vouched.
Vouched may modify, throttle, suspend, or discontinue the API or any aspect thereof at any time, with or without notice. Vouched has no obligation to provide support for the API.
All data provided through the API is subject to the disclaimers and limitations of liability set forth in Section 7.
The Services may integrate with or depend on third-party platforms and services, including cloud infrastructure providers, authentication services, messaging platforms, and AI model providers. Vouched is not responsible for the availability, performance, security, or terms of any third-party service. Your use of third-party services in connection with the Services is subject to the applicable third-party terms and policies.
You acknowledge that information you submit through chat or conversational features of the Services, including questions, feedback, images, files and descriptions of issues, may be used by Vouched to improve, train, and develop the Services and related technologies. This right survives termination of these Terms.
(A) YOU EXPRESSLY AGREE THAT USE OF THE WEBSITE AND THE SERVICES IS AT YOUR SOLE RISK. NEITHER VOUCHED, ITS AFFILIATES, NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS, THIRD-PARTY SERVICE PROVIDERS, OR LICENSORS WARRANT THAT USE OF THE WEBSITE OR THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE WEBSITE OR THE SERVICES, NOR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE WEBSITE. THE WEBSITE AND THE SERVICES SHOULD NEVER BE RELIED UPON AS THE SOLE BASIS FOR MAKING ANY DECISIONS TO PURCHASE SERVICES FROM VOUCHED OR TO PURCHASE OR USE ANY THIRD-PARTY PRODUCT OR SERVICE.
(B)THE WEBSITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THESE TERMS.
(C) TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL VOUCHED BE LIABLE TO YOU FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER AND/OR DEVICE OR TECHNOLOGY FAILURE OR MALFUNCTION OR FOR ANY FORM OF DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES BASED ON ANY CAUSES OF ACTION ARISING OUT OF USE OF THE WEBSITE OR THE SERVICES OR ANY ALLEGED FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, OR DELAY IN SERVICE, OPERATION, OR TRANSMISSION OF THE WEBSITE OR THE SERVICES, OR ANY ALLEGED COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OF PROPERTY, AND/OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF OR POSTING OF ANY RECORD, CONTENT, OR TECHNOLOGY, PERTAINING TO OR ON THE WEBSITE. YOU AGREE THAT THIS LIMITATION OF LIABILITY APPLIES WHETHER SUCH ALLEGATIONS ARE FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR FALL UNDER ANY OTHER CAUSE OF ACTION, REGARDLESS OF THE BASIS UPON WHICH LIABILITY IS CLAIMED AND EVEN IF VOUCHED OR FUTURE PARENT OR AFFILIATED COMPANIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU ALSO SPECIFICALLY ACKNOWLEDGE THAT VOUCHED OR FUTURE PARENT OR AFFILIATED COMPANIES ARE NOT LIABLE FOR ANY ACTUAL OR ALLEGED DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OF THE WEBSITE OR ANY OTHER THIRD PARTIES.
IF APPLICABLE LAW DOES NOT ALLOW ALL OR ANY PART OF THE ABOVE LIMITATION OF LIABILITY TO APPLY TO YOU, THE LIMITATIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
(D) To the fullest extent permitted by applicable law, we disclaim any and all liability of any kind for any unauthorized access to or use of your personally identifiable information. (E) You acknowledge and agree that Vouched is not responsible and shall have no liability for the content of any third-party sites that are linked to the Website or other online products or services that are owned and operated by third parties, including any products or services made available through third-party sites, or for your use of or interaction with third-party sites.
You agree to defend, indemnify and hold harmless Vouched, its affiliates and their respective directors, officers, employees and agents from and against all claims, actions, demands, losses, damages, costs, liabilities and expenses, including attorneys' fees, arising out of or related to (a) your access to or use of the Website, including the Services, (b) your violation of these Terms, or (c) your breach of your representations and warranties provided herein. Vouched reserves the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this section. In such event, you shall provide Vouched with such cooperation as is reasonably requested by Vouched.
We may terminate or suspend these Terms at any time without notice to you. Without limiting the foregoing, we shall have the right to immediately terminate your access to the Website, or any part thereof, including your access to the Services, in the event of any conduct by you which we, in our sole discretion, consider to be unacceptable, or in the event of any breach, or suspected breach, by you of any of these Terms. The following provisions shall survive termination of these Terms: Section 5 (Intellectual Property), Section 6 (Services Terms), Section 7 (Disclaimer of Warranty, Limitation of Liability), Section 8 (Indemnification), Section 9 (Termination), Section 10 (International Access, Governing Law, and Venue), Section 11 (Class Action Waiver) and Section 12 (Miscellaneous).
The Website and the Services are operated from, and directed to users in, the United States. We make no representation that the Website, the Services, or any Content are appropriate or available for use in other locations. If you access or use the Website or the Services from outside the United States, you do so at your own risk and are solely responsible for compliance with all applicable local laws and regulations.
Any and all disputes, claims and controversies arising out of or in connection with your access to, and/or use of the Website or the Services, and/or the provision of content, services, and/or technology on or through the Website shall be governed by and construed exclusively in accordance with the laws and decisions of the State of Washington applicable to contracts made, entered into and performed entirely therein, without giving effect to its conflict of laws provisions. You and Vouched submit to the personal and exclusive jurisdiction of the state courts and federal courts located within King County, Washington for resolution of any lawsuit or court proceeding permitted under these Terms.
EACH OF YOU AND VOUCHED HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION (INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS, COUNTERCLAIMS, CROSS-CLAIMS, OR THIRD-PARTY CLAIMS) ARISING OUT OF, UNDER OR IN CONNECTION WITH THESE TERMS. FURTHER, EACH OF YOU AND VOUCHED HEREBY CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF THE OTHER HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT THE OTHER WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF YOU AND VOUCHED ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR EACH OF THEM, RESPECTIVELY, TO ENTER INTO AGREEMENT PURSUANT TO THESE TERMS.

THE PARTIES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH PARTIES AGREE OTHERWISE, ANY ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S OR PARTY'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY'S INDIVIDUAL CLAIM(S).
These Terms and any operating rules for the Website established by us, including our Privacy Statement, which is hereby incorporated into these Terms, constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. The provisions of these Terms are for the benefit of the Vouched, its affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. If any part of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, it will be replaced with language reflecting the original purpose in a valid and enforceable manner. The enforceable sections of these Terms will remain binding upon the parties. The section headings used herein are for convenience only and shall not be given any legal import.
Any reliance on the Website and materials provided by Vouched is at your own risk, and you assume any and all risks associated with your purchase decisions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Website is inaccurate at any time without prior notice (including after you have submitted your order), but we have no obligation to update any information on our Website. You agree that it is your responsibility to monitor changes to our Website.
Certain features or services available through the Website may be subject to additional or supplemental terms, conditions, or policies, including service-specific terms, payment terms, acceptable use policies, or service level commitments ("Supplemental Terms"). Supplemental Terms will be posted on or linked from the Website or otherwise made available to you in connection with the applicable feature or service. By accessing or using any feature or service that is subject to Supplemental Terms, you agree to those Supplemental Terms. Vouched may also offer enterprise services for all or part of the Services, subject to separate written agreements. To the extent of any conflict between these Terms and the terms of a separate enterprise agreement, the enterprise agreement shall control with respect to the applicable enterprise services.
